This Back to College Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia, excluding Florida and New York, who are at least 18 years old and the age of majority in their jurisdiction of residence at the time of entry. Sponsor (“defined below”) and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals (defined as any spouse, domestic partner, parent, legal guardian, grandparent, sibling, child or legal ward, or grandchild, regardless of where they reside) and members of the same household (whether legally related or not) of any such person are, are not eligible to participate.
Void in Florida, New York, outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Winning a prize is contingent upon fulfilling all requirements set forth herein.
The Sweepstakes sponsor is Shipt, Inc. (“Sponsor”), located at 420 20th St. N #100, Birmingham, AL 35203. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.
This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram LLC or Facebook, Inc. The information you provide will only be used as provided in Sponsor’s privacy policy. If you are selected as a winner, your information may also be included in a publicly available winner’s list. Any questions, comments, or complaints regarding this Sweepstakes shall be directed to Sponsor and not to Instagram or Facebook.
The entry period for this Sweepstakes shall be from July 18, 2022 8:00:00 am CST through July 25, 2022 11:59:59 pm CST as further set forth and subject to the below (“Entry Period”). Mail-in entries must be postmarked during the Entry Period and received no later than two (2) business days following the conclusion of the applicable of the Entry Period by 5:00:00 pm CST of the applicable Entry Period. Sponsor’s computer is the official time keeping device for this Sweepstakes.
Entry via Facebook and Instagram. During the Entry Period, log into your Facebook or Instagram account, visit Sponsor’s official Facebook page (https://www.facebook.com/Shipt/) and/or Sponsor’s official Instagram account (https://instagram.com/shipt), follow Sponsor’s official Facebook Page and/or Instagram account and locate the Sweepstakes post (“Post”). Then, (i) like the Post, and (ii) respond to the Post’s prompt by posting a comment on the Post and include the hashtag #BackToCollegeGiveaway to receive one (1) entry into the Sweepstakes.
Entry via Mail-In. For those that wish to enter without participating on social media, please send a request for entry to 420 20th St. N #100, Birmingham, AL 35203 Attn: Shipt #BackToCollegeGiveaway SWEEPSTAKES. All requests for entry must be received by the deadline for the Entry Period noted above for mail-in Entries in “Entry Period.” if entering via mail-in entry. As part of your mail-in submission, please include basic contact information, including your name, street address, phone number, and email address. (NOTE: You must complete all required submission information with either the survey response or the mail in offering with information that is valid on the date of the drawing to be eligible). You understand you are providing your information to Sponsor and/or Administrator and not to a third-party. All entries become the property of Sponsor, and none will be acknowledged or returned.
Automated entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple email addresses or Instagram or Facebook accounts, nor may entrants use any other device or artifice to enter multiple times or as multiple entrants. If it is discovered that an entrant has entered or attempted to enter the Sweepstakes multiple times using multiple identities, Instagram or Facebook accounts, or email addresses, or that an entrant submitted or attempted to submit more than the Entry limit, all of participants Entries will be declared null and void, and any prize entrant might have been entitled to will not be awarded. Each Entry will be subject to Instagram and/or Facebook Terms of Use, and must comply with the Entry requirements set forth herein. Presence of an Entry on Instagram or Facebook is not a confirmation, representation, or warranty by the Sponsor or any of its representatives that the Entry is compliant with these Official Rules. Sponsor’s decisions with respect to whether an Entry complies with these Official Rules are final and binding and may be made by Sponsor at any time. Entries that do not meet the requirements set forth in these Official Rules may not be acknowledged and may be automatically disqualified, in the sole discretion of the Sponsor. Sponsor is not responsible for incorrect or inaccurate Entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or Instagram or Facebook or by any technical or human error that may occur in the processing of the Entries. Entries will not be judged, but must comply with all requirements set forth herein, including the content requirements.
As used herein, “Entry”/”entry” (and/or “entries”/“Entries”) refers to all content you submit in connection with the Sweepstakes (including, but not limited to, posts, descriptions, explanations, hashtags, tag names, etc.), if any.
Entrants represent and warrant that their Entry is the original work of such entrant, it has not been copied from others, it has not previously won awards, it does not violate the rights of any other person or entity, and publication of the Entry via various media including Web posting will not infringe on the rights of any third party. Any such entrant will indemnify and hold harmless Released Parties (defined below) from any claims to the contrary. Any entrant whose Entry includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such Entry, in a form satisfactory to administrator, upon request, prior to award of prize and/or naming of entrant as a winner.
By submitting an Entry, you agree that your Entry is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to use or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.
BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY WILL BE POSTED ON THE PUBLIC INTERNET.
All Entries you submit must conform to the additional submission requirements set forth herein:
• Entry must comply with these Official Rules and any terms of use on the Facebook and Instagram websites;
• Entry must comply with the posting requirements set forth herein and as set forth in all Facebook and Instagram guidelines;
• Entry cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
• Entry cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
• Entry cannot be obscene or offensive, endorse any form of hate or hate group;
• Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
• Entry cannot infringe trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind (other than Sponsor’s brands/products), without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
• Entry cannot infringe on copyrighted materials owned by others;
• Entry cannot contain materials embodying the name or other indicia identifying any person, living or dead, without permission;
• Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate (as determined by Sponsor in its sole discretion); and
• Entry cannot depict, and cannot itself, be in violation of any law.
ENTRIES POSTED TO THE WEBSITE ARE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. Sponsor reserves the right to waive the Entry submission requirements set forth herein in its reasonable discretion.
Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Entry Period, to request that any entrant resubmit his or her Entry which fails to comply with the Sweepstakes entry requirements prior to any drawing.
LIMIT ONE ENTRY PER PERSON DURING ENTRY PERIOD. No third party entry or entry through any sweepstakes service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified.
Use of robotic entry devices is strictly prohibited.
One (1) Grand Prize will be awarded. The Grand Prize consists of one (1) five-thousand dollar ($5000) Shipt member credit valued at five-thousand dollars ($5000) and one (1) annual Shipt membership valued at ninety-nine dollars ($99). Approximate Retail Value (“ARV”): five-thousand ninety-nine dollars ($5099 USD). Limit of one (1) prize per social media account /person /email address for the entire Entry Period. If a prize cannot be awarded for any reason, Sponsor reserves the right to substitute the prize with another prize of equal or greater value. Additional prize restrictions, conditions, limitations, and details are provided in the Post.
The prize is non-transferable, and no substitution or cash equivalent is permitted. The winner is responsible for federal, state, and local taxes, if applicable. The prize is awarded “as is” without any warranty or guarantee, either express or implied, by Sponsor or Administrator.
LIMIT ONE GRAND PRIZE.
The winner will be selected in a random drawing from among all eligible entries collected during the Entry Period. Random drawing shall occur on or about June 28, 2022 at Sponsor’s principal place of business. The drawing will be conducted by Sponsor, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means. If there is a dispute about the identity of an entrant, the prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address received with the survey response, or the physical address associated with the mail in entry. If the winner is found to be ineligible or not in compliance with these Official Rules, the winner will be disqualified, and an alternate winner will be awarded the prize in a separate random drawing.
Winner will be notified by social media or telephone on or around June 28, 2022. The inability of Sponsor to contact winner by telephone or receive an acknowledgement response on social media within seventy-two (72) hours after selection, may result in disqualification of the winner and an alternate winner may be selected in a random drawing at Sponsor’s discretion.
Shipt Member: The prize will be automatically attributed to the Shipt Member’s account within fourteen (14) days after the winner has been notified and accepted the prize. If the prize is declined or returned, then the prize will be forfeited, and another winner will be randomly drawn from the remaining eligible Entries.
Non-Shipt Member: Non-Shipt members will need to set up a Shipt member account before receiving the prize, within fourteen (14) days after the winner has been notified and accepted the prize. If the non-Shipt member isn’t able to set up a Shipt member account, then the prize will be forfeited, and another winner will be randomly drawn from the remaining eligible Entries.
Sponsor shall not be held responsible for any change of email address, mailing address, telephone number, or other contact information of entrants, or for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to verified winners and to addresses within the 50 U.S./D.C. IN ORDER TO RECEIVE A PRIZE, WINNERS MUST PROPERLY SIGN AND SUBMIT ANY RELEASES, LICENSES, OR OTHER AGREEMENTS REQUIRED BY SPONSOR AND COMPLETELY AND ACCURATELY PROVIDE SUCH INFORMATION AS IS REASONABLY REQUESTED BY SPONSOR IN CONNECTION WITH THIS SWEEPSTAKES. FAILURE TO DO SO MAY, IN SPONSOR’S DISCRETION, RESULT IN DISQUALIFICATION AND SELECTION OF AN ANOTHER PRIZE WINNER.
The odds of winning will depend on the number of eligible Entries received, according to the eligibility requirements in the Sweepstakes.
ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
By entering this Sweepstakes, entrants promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify or withdraw any entry at any time. All issues of interpretation to be decided by Sponsor. Entrants who have not complied with these Official Rules and the Post are subject to disqualification and all associated Entries will be void.
Sponsor will not be responsible for any injury, damage or loss of any kind arising out of your participation in the Sweepstakes.

FURTHER, AND WITHOUT LIMITING THE FOREGOING, RELEASED PARTIES HAVE NO LIABILITY, AND YOU AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS RELEASED PARTIES IN THE EVENT APPLICABLE LAW, TECHNICAL ERRORS, OR OTHER MATTERS PREVENT THIS SWEEPSTAKES FROM BEING RUN AS CONTEMPLATED BY THESE RULES. YOU FURTHER ACKNOWLEDGE THAT THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK, INC. AND/OR INSTAGRAM LLC.
Except where prohibited by law, by accepting prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
Any controversy or claim arising out of or relating to this Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Delaware law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.
These Official Rules and the Sweepstakes are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Delaware, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 10 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in Wilmington, Delaware.
The name of winner(s) is available only within (14) days after the close of the Sweepstakes.
